Always void. Since February 2026, also a matter for whoever arranged it.
A nominee arrangement is where an Indonesian citizen holds freehold title on paper while a foreigner holds the money, the use, and a drawer full of side agreements. A loan agreement. A mortgage. A power of attorney. A statement that the nominee relinquishes any claim. Stacked together they are meant to look like control.
Send the question. It goes to a person, not a form, and the answer comes back with the document it sits on.

They are not control. They are paper resting on an arrangement that Indonesian law treats as never having existed.
Article 26 paragraph 2 of the Basic Agrarian Law voids any legal act intended, directly or indirectly, to transfer freehold ownership to a foreign national. Not voidable at someone's request. Void by operation of law, from the beginning.
Void from the beginning is a harder position than most buyers realise. There is no contract to enforce, because in the eyes of the law there was never a contract. If the nominee sells the land, mortgages it, dies and leaves it to their family, or simply asserts one morning that it is theirs, the foreigner has no title to assert and no obvious route to recover the money.
The side agreements do not survive the thing they are attached to. The loan, the mortgage, the power of attorney and the relinquishment all rest on the same void purpose. We could not find a single reported case in which those instruments rescued a foreign buyer once the underlying purpose was proven. That is not the same as saying it has never happened. It is to say the evidence is not there, and anyone who tells you the structure is tested should be asked to produce the case number.
Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2026 came into force on 24 February 2026. It deals with the conversion of productive agricultural land and with nominee ownership, and it is the second half that the market has been slower to absorb.
Article 1, paragraph 11 defines the arrangement directly: designating a person to hold or manage land rights on behalf of a foreign national who is the beneficial owner. Having a definition in a regional regulation matters, because it removes the argument that nominee structures occupy a grey area nobody has described.
Article 14 prohibits acting as an intermediary or a facilitator for a foreign national acquiring land through such a scheme. Read that twice. It reaches the agent, the arranger and the adviser, not only the buyer and the nominee.
Article 20 sets out the sanctions. Written warnings, temporary suspension of activity, closure of the location, revocation of licences, demolition of buildings, restoration of the land to its former use, and administrative fines. Civil servants face separate disciplinary consequences. Criminal penalties under higher legislation are referred to as remaining applicable, though no source we read set out a specific offence or a specific penalty, so we are not going to invent one.
Article 19 requires the Governor to establish an oversight team.
Article 24 brings subak, the traditional irrigation cooperatives, and village councils into the monitoring role within their own customary jurisdictions.
That is the provision most likely to change the practical risk, and it is the one least discussed in English language commentary. Enforcement by a distant provincial body is one thing. Enforcement that starts with the neighbours, the irrigation cooperative that manages the water your land sits beside, and the village council that has known the nominee's family for three generations, is a different proposition entirely. It is local, it is continuous, and it does not require anyone to file a complaint in Denpasar.
Nothing we have read addresses what happens to nominee arrangements that already existed before February 2026. Not the regulation as reported, not the legal commentary on it.
Whether there is grandfathering, a transition period, or nothing at all, we do not know. Neither does anyone asserting otherwise online. Anyone who tells you that existing structures are safe is telling you something they cannot support, and the confident version of that answer is worth less than the honest one.
Ask your notary, in writing: does Perda 4/2026 contain transitional provisions for arrangements entered into before February 2026, and if so, what are they?
Very few people will offer you a nominee structure by name. What they will offer is a package that has the same shape.
The title stays in an Indonesian name and you are told this is normal. You are given a set of agreements described as securing your position rather than a title in your own right. The word used is control rather than ownership. Someone offers to introduce a trusted local, sometimes a staff member, sometimes a relative of the agent. The structure is described as what everybody does here, or as tested, without a case number attached. Or the price is materially below comparable leasehold, and the discount is doing the work of explaining itself.
None of those is proof on its own. Together they describe an arrangement that Article 26 treats as void and Article 14 now treats as an offence to arrange.
A foreign buyer has real options that do not depend on somebody else's name being on the certificate. Leasehold, held in your own name for a defined term with an expiry date on the deed. Hak Pakai, the right to use, for a foreigner holding the appropriate stay permit. Or a PT PMA, a foreign investment company, which can hold Hak Guna Bangunan, the right to build.
Each has real trade-offs, and the right answer depends on how long you intend to hold, whether the property will earn, and what you want to happen at the end. Those are covered in the Bali Buyer's Guide, which sets out what each structure is, what it costs to run, and when a PT PMA is overkill for the size of what you are buying.
Bali Property Sourcing does not arrange nominee structures and will not introduce you to anyone who does.
That is not caution and it is not virtue. Article 14 makes facilitating one a matter for the facilitator as well as the buyer. Given the choice between losing a transaction and being the intermediary named in a provincial regulation, losing the transaction is not a difficult decision.
Ask your notary, in writing: is the structure being proposed to me a nominee arrangement within the meaning of Article 1 paragraph 11 of Perda Bali 4/2026, and what is your view on its enforceability?
This page describes publicly available law and is not legal advice. Bali Property Sourcing is a real estate agency and buyer's agent, not a law firm. Every buyer should take the questions above to an independent notary before committing money.
There is no building to inspect, so the contract is the building. Here is what to read in it, in the order that matters.
The company route to holding property in Bali. What it costs to keep, and the version of HGB almost nobody mentions.
Every property listed here has been vetted before it went up. Ask what those documents actually say before a deposit changes hands, not after.
